    These Terms of Service ("Terms") govern your use of the Accident Book platform and services. By accessing or using our services, you agree to be bound by these Terms.

    1. Definitions

    • "Service" means the Accident Book digital incident management platform
    • "User" means any individual who accesses or uses the Service
    • "Organisation" means the business entity that subscribes to our Service
    • "Content" means any data, text, images, or other materials uploaded to the Service

    2. Account Registration

    To use our Service, you must register for an account. You agree to:

    • Provide accurate and complete registration information
    • Maintain the security of your account credentials
    • Notify us immediately of any unauthorised access
    • Accept responsibility for all activities under your account

    3. Subscription and Payment

    3.1 Subscription Plans

    Access to our Service requires a paid subscription. Subscription details, including pricing and features, are available on our website.

    3.2 Free Trial

    We offer a 7-day free trial for new subscribers. No payment is required during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

    Subscriptions are billed in advance on a monthly basis. All fees are non-refundable except as expressly stated in these Terms or required by law.

    3.4 Price Changes

    We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price increases.

    4. Acceptable Use

    You agree not to:

    • Upload false, misleading, or fraudulent incident reports
    • Attempt to gain unauthorised access to any part of the Service
    • Interfere with or disrupt the Service or its infrastructure
    • Share your account credentials with unauthorised parties
    • Use the Service to store or transmit malicious code
    • Reverse engineer, decompile, or disassemble the Service

    5. Your Content and Data

    5.1 Ownership

    You retain ownership of all Content you upload to the Service. By uploading Content, you grant us a limited licence to store, process, and display that Content solely for the purpose of providing the Service.

    5.2 Accuracy

    You are responsible for the accuracy and completeness of all incident reports and other Content you submit. The Service is designed to assist with record-keeping and compliance, but does not constitute legal advice.

    5.3 Data Protection

    We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including UK GDPR.

    6. RIDDOR and Regulatory Compliance

    Our Service includes features to assist with RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations) compliance. However:

    • You remain solely responsible for determining whether an incident is RIDDOR-reportable
    • You are responsible for submitting any required reports to the HSE within statutory deadlines
    • Our automated assessments are advisory only and do not constitute legal advice
    • We do not guarantee the accuracy of RIDDOR classification suggestions

    7. Service Availability

    We strive to provide reliable, uninterrupted access to our Service. However:

    • We do not guarantee 100% uptime
    • We may perform scheduled maintenance with reasonable notice
    • We are not liable for interruptions beyond our reasonable control

    8. Intellectual Property

    The Service, including its software, design, logos, and documentation, is owned by Accident Book Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

    9. Limitation of Liability

    To the maximum extent permitted by law:

    • Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim
    • We are not liable for indirect, incidental, special, or consequential damages
    • We are not liable for any regulatory fines or penalties you may incur
    • We are not liable for decisions made based on data or reports generated by the Service

    Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

    10. Indemnification

    You agree to indemnify and hold harmless Accident Book Ltd from any claims, damages, or expenses arising from:

    • Your use of the Service
    • Your violation of these Terms
    • Your violation of any third-party rights
    • Content you upload to the Service

    11. Termination

    11.1 By You

    You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

    11.2 By Us

    We may suspend or terminate your access if you:

    • Breach these Terms
    • Fail to pay subscription fees
    • Engage in conduct that harms other users or our reputation

    11.3 Effect of Termination

    Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data, subject to any legal retention requirements.

    12. Changes to Terms

    We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

    13. Governing Law and Disputes

    These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

    14. General Provisions

    • Entire Agreement: These Terms constitute the entire agreement between you and Accident Book Ltd regarding the Service
    • Severability: If any provision is found unenforceable, the remaining provisions continue in effect
    • Waiver: Failure to enforce any right does not constitute a waiver of that right
    • Assignment: You may not assign your rights under these Terms without our consent
